The Privacy Of The Duty To Inform In Adventure Tourism Contracts: A Guarantee For Protecting The Tourist From Risks

Authors : Benlecheheb Asma .

Abstract

Adventure tourism is a prominent form of modern tourism, involving activities fraught with risks. Considering the tourist as a consumer, their need for protection becomes more imperative given their weak position vis-à-vis the travel agency. Therefore, the duty to inform emerges as a mechanism to protect them in adventure tourism contracts, enabling them to be aware of the risks associated with the adventure so they can make an informed decision before participating. This study addressed the concept and content of the duty to inform in such contracts, as well as the forms and consequences of its breach. It concluded that the absence of specific legislative regulation for adventure tourism in Algeria limits the effectiveness of protection, necessitating the enactment of an independent legal framework that enshrines the duty to inform as a mechanism to balance investment requirements and ensure the tourist's safety from risks.
