Abstract
This research paper tackled the Algerian state’s endeavours to modernise its services, by establishing the delegation technique as a modern method of administration and management. Thanks to it, the private sector can participate in the management of public services affiliated with the state and regional communities, through various forms of contracts. The study highlighted a type of delegation, i.e. the lease contract, where all its legal controls were covered, especially at the local level, by identifying the conceptual and legal framework of the lease-by-delegation contract and its specificities. The methods and procedures for concluding it were also addressed, in accordance with the Executive Decree No. 18/199
