تجسيد النزاهـة والشفافية إثر إبرام الصفقات العمومية في ظل القانون رقم 23-12

الملخص
إن الصفقات العمومية عبارة عن عقود إدارية مكتوبة، تبرم بين المصلحة المتعاقدة ومتعامل متعاقد واحد أو أكثر، لكن من أجل نجاعة ذلك لابد من احترام قواعد النزاهة والشفافية في مجال هذا النوع من العقود. وكل ذلك واضح من خلال المواد من 65 إلى غاية المادة 71 من القانون رقم 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية، حيث نجد أن للمصلحة المتعاقدة دور إيجابي باتخاذها لتدابير ذات طابع ردعي عند اكتشاف فساد أو انحياز قبل أو أثناء أو بعد إبرام هذه الصفقة، ومن أجل الحد من هذه الممارسات الغير نزيهة أقر المشرع من خلال هذا القانون حالة تنافــي العضوية في لجنة التحكيم و /أو صفة المقرر في لجنة الصفقات العمومية مع العضوية في لجنة فتح الأضرفة وتقييم العروض، بالإضافة إلى إتخاد تدابير وقائية أخرى منصوص عليها في هذا القانون، وكل ذلك من أجل تكريس مبدأ المنافسة النزيهة في مجال هذا النوع من العقود . Public contracts are written administrative contracts concluded between the contracting authority and one or more contracting parties. All of this is clear from Articles 65 to 71 of Law No. 23-12 defining the general rules related to public contracts, Whereas we find that the contracting authority has a positive role in taking measures of a deterrent nature when corruption or bias is discovered before, during or after the conclusion of this deal, and in order to limit these unfair practices, the legislator has approved through this law the case of incompatibility of membership in the arbitration committee and/or the position of rapporteur in the public procurement committee with membership in the envelope opening and bid evaluation committee, In addition to taking other preventive measures stipulated in this law, all in order to establish the principle of fair competition in the field of this type of contract.
