رقابة القاضي الإداري على سلطة ضبط الكهرباء والغاز وفقا للتشريع الجزائري

الملخص
يعتبر قطاع الكهرباء والغاز من بين القطاعات الإستراتيجية المساهمة في التنمية الوطنية، يسير هذا القطاع من طرف مؤسسة " كهرباء وغاز الجزائر"، ثم أسند التسيير للشركة الوطنية للكهرباء والغاز، وبعدها تم تحرير هذا القطاع إثر صدور القانون رقم 02-01 المتعلق بالكهرباء وتوزيع الغاز بواسطة القنوات، لذا بعدما كانت الدولة محتكرة لهذا القطاع من قبل السلطة المركزية الممثلة بالوزير المكلف بالطاقة، تم إنشاء هيئة مستقلة تتمثل في لجنة ضبط الكهرباء والغاز بموجب المادة 111 من هذا القانون، التي يمكن أن تخضع قراراتها لرقابة مجلس الدولة، تطبيقا لأحكام المادة 139 من القانون رقم 02-01، إذ يمكن أن تكون قراراتها ذا طابع تنظيميي أو استشاري وتحكيمي، أو تمتعها بسلطة الرقابة والتحقيق، لذا لابد من دراسة مدى شرعية ودستورية الرقابة القضائية على هذه القرارات، خاصة في ظل ممارستها للدور العقابي. The electricity and gas sector is considered one of the strategic sectors contributing to national development. This sector was initially managed by the "Electricity and Gas of Algeria" company, and then management was entrusted to the National Electricity and Gas Company. This sector was subsequently liberalized following the enactment of Law No. 02-01 relating to electricity and gas distribution via pipelines. Thus, after the state had monopolized this sector through the central authority represented by the Minister in charge of Energy, an independent body was established, namely the Electricity and Gas Regulatory Commission, pursuant to Article 111 of this law. Its decisions may be subject to the oversight of the Council of State, in accordance with the provisions of Article 139 of Law No.02-01, as its decisions may be of a regulatory, advisory, or arbitration nature, or it may have the power of oversight and investigation. Therefore, it is necessary to study the legitimacy and constitutionality of judicial oversight of these decisions, especially in light of its punitive role.
