التضخم الحقوقي و خطر تآكل الحقوق الدستورية: دراسة في التوازن بين الوفرة القانونية و الفاعلية التطبيقية

الملخص
استعرضت هذه الدراسة ظاهرتي التضخم الحقوقي وتآكل الحقوق الدستورية من منظور العلاقة بين الوفرة القانونية وفعالية التطبيق العملي للحقوق الأساسية، وتتوصلت النتائج إلى أن التوسع المفرط في القواعد الحقوقية، رغم كونه تعبيرًا عن تطور الوعي بحقوق الإنسان، يؤدي أحيانًا إلى تشتت الموارد، إضعاف القيمة المعيارية للحقوق الأساسية، وخلق فجوات تنفيذية تقلل من حماية الحقوق الجوهرية مثل الحق في الحياة، و السلامة الجسدية والحق في الحرية، والمساواة، واعتمدت الدراسة على المنهجين الوصفي و التحليلي مع االاستعانة باسلوب المقارنة، من خلال تحليل النصوص الوطنية والدولية، ومراجعة التجارب العملية لدول مختلفة، وتقييم التأثيرات العملية للتوسع الحقوقي. وخلصت الدراسة إلى أن تحقيق التوازن بين الوفرة القانونية والفاعلية التطبيقية، من خلال تبني مبادئ الأمن القانوني، التدرج في الإقرار، المصلحة العليا، وتعزيز القدرات التنفيذية والقضائية، يمثل السبيل الأمثل لضمان حماية النواة الصلبة للحقوق الدستورية . This study examines the phenomena of rights inflation and the erosion of constitutional rights from the perspective of the relationship between legal abundance and the practical effectiveness of fundamental rights. The findings indicate that excessive expansion of rights, while reflecting the development of human rights awareness, can lead to resource dispersion, weakening of the normative value of core rights, and the creation of implementation gaps, thereby diminishing the protection of essential rights such as the right to life, freedom, and equality. The study adopts a comparative analytical approach, combining the analysis of national and international legal texts with the review of practical experiences in various countries, assessing the real-world effects of rights expansion. It concludes that achieving a balance between legal abundance and practical effectiveness, through the adoption of the principles of legal certainty, gradual realization, public interest, and strengthening institutional and judicial capacities, represents the optimal approach to safeguarding fundamental constitutional rights.
