الضبط الإداري بين حماية النظام العام وضمان الحريات العامة

الملخص
ان اندماج الفرد في النسيج الاجتماعي يقتضي بالضرورة أن يتمتع بجملة من الحقوق والحريات يترتب على ذلك ممارسة العديد من الأنشطة والمعاملات، وفقا لضوابط قانونية وتنظيمية تفرضها ضرورة الموازنة بين المصلحة الاجتماعية ومتطلبات النظام العام، وهنا تظهر سلطة الإدارة يقع على عاتقها المحافظة على النظام العام في المجتمع من خلال ممارسة مهام الضبط الإداري الذي يكفل تنظيم ممارسة الحريات العامة، غير ان الإدارة وفي سبيل ممارسة مهامها قد تميل الى تجاوز صلاحياتها في بعض الحالات مما يقيد ويقلص من ممارسة هذه الحريات العامة. وبما ان هذه الأخيرة مكفولة دستوريا وجب احترامها وتحقيق ضمانات ممارستها. The integration of the individual into the social fabric necessarily requires that he enjoy a set of rights and freedoms, which entails the exercise of many activities and transactions, in accordance with legal and regulatory controls imposed by the need to balance the social interest and the requirements of public order, and here appears the authority of the administration, which is responsible for maintaining public order in society by exercising administrative control functions that ensure the regulation of the exercise of public freedoms, but the administration may tend to exceed its powers in some cases, which restricts and curtails the exercise of these public freedoms. Since these freedoms are constitutionally guaranteed, they must be respected and their exercise must be guaranteed.
