القواعد الحسابية لميراث الجد مع الإخوة الأشقاء والإخوة لأب وفق قانون الأسرة الجزائري

الملخص
يعالج المقال موضوع من مواضيع الأسرة، ويتعلق بالجانب المالي لأفراد الأسرة وهو الميراث، ونظرا لدقة موضوع الميراث وتشعبه سنركز في الدراسة على موضوع جِدُ مهم؛ وهو ميراث الجد بوجود الإخوة الأشقاء أو الإخوة لأب، ومع وجود أصحاب الفروض أو غيابهم، وستكون الدراسة بالشرح المستفيض لأحكام ميراث الجد. وستتميز الدراسة بالشرح عن طريق استخدام جداول الميراث التي تسهل للقارئ فهم ميراث الجد نظرا لتشعب أحكامه ودقتها، وعرض القواعد الحسابية التي يمكن من خلالها حل مسائل الجد، وذلك بالاستناد لمواد قانون الأسرة والتي ضبطت أحكام ميراث الجد في القانون 84-11 المعدل والمتمم بموجب الأمر 05-02 الصادر بتاريخ 27 فبراير 2005، وكذا بالرجوع إلى المسائل الفقهية المسكوت عنها قانون الأسرة كمسألة المعاداة في ميراث الجد بعرض الآراء الفقهية المختلف فيها وتبسيط طريقة حل مسائلها وفق مذهب زيد. Abstract: The article deals with a family topic, and is related to the financial aspect of family members, which is inheritance. Given the accuracy and complexity of the topic of inheritance, we will focus in the study on a very important topic; It is the grandfather's inheritance in the presence of full brothers or paternal brothers, and in the presence or absence of the holders of the inheritance. The study will provide a detailed explanation of the provisions of the grandfather's inheritance. The study will be distinguished by its explanation through the use of inheritance tables, which facilitate the reader’s understanding of the grandfather’s inheritance due to the complexity and accuracy of its provisions, and the presentation of the mathematical rules through which the grandfather’s issues can be solved, based on the articles of the Family Code, which set the provisions of the grandfather’s inheritance in Law 84-11, amended and supplemented by Order 05. -02 dated February 27, 2005, as well as by referring to the jurisprudential issues that the Family Law was silent about, such as the issue of hostility in the grandfather’s inheritance, by presenting the disputed jurisprudential opinions and simplifying the method of resolving their issues according to the doctrine of Zayd
