Towards The Adaptation Of International Civil Liability Principles In Response To Offences Against Revealed Religions: A Legal And Human Rights Perspective

Authors : Benkouider Tahar .

Abstract

This study explores the potential adaptation of international civil liability principles to address offences committed against revealed religions, with particular focus on recent attacks on Islamic symbols by certain Western media outlets, often justified under the guise of freedom of expression. The research investigates the extent of state responsibility under international law for failing to prevent or condemn such acts, considering violations of obligations to protect religious freedom and uphold fundamental human rights. It critically analyses the conceptual foundations of civil liability and evaluates mechanisms of state accountability, including instruments within the United Nations human rights system and the jurisdiction of the International Court of Justice. The study concludes that existing legal frameworks are insufficient and advocates for the establishment of a dedicated international convention, supported by specialised enforcement mechanisms.
