Transfer Of Obligation As A Legal Mechanism To Ensure The Continuity Of Rights And Obligations: An Analytical Study In Light Of The General Principles Of Civil Law

Abstract

The transfer of obligations is a fundamental concept in civil law, encompassing the rules governing the assignment of rights and the assignment of debts, along with their legal implications for the parties involved. This study aims to clarify the conditions and legal requirements regulating such transfers, and examines the legal framework that seeks to balance the interests of creditors, debtors, and third parties. Through an analytical approach, the paper highlights how legislative provisions ensure legal stability and promote contractual justice. The study ultimately contributes to a better understanding of the mechanisms that safeguard the continuity of civil legal relationships. إن موضوع انتقال الالتزام يعد أحد المفاهيم الجوهرية في نطاق القانون المدني، مركزا على أحكام حوالة الحق وحوالة الدين وما يترتب عليهما من آثار قانونية تجاه أطراف العلاقة، ويهدف إلى بيان الشروط والضوابط التي تحكم انتقال الالتزام، مع استعراض الإطار القانوني الذي ينظم انتقال الالتزام بما يحقق التوازن بين مصالح الدائن والمدين والغير، حيث يسعى هذا التنظيم التشريعي إلى حماية الاستقرار القانوني وتحقيق العدالة التعاقدية.
