Algeria is suffering from the spread of the drug scourge, including abuse, promotion, trade, industry, and smuggling, as a result of its geographical proximity to the homeland of drug cultivation and export to the west and south, and consumption to the north, to the point where it has become not only a transit zone, but also a large consumption one. This prompted Algerian legislators to adopt a modern strategy to combat drug crimes in all forms, as evidenced by Law 23/05 relating to the prevention and repression of the illicit use and trafficking of narcotics and psychotropic substances. So, what are the pillars on which the Algerian legislator's modern strategy is based, as outlined in Law 23/05? These foundations are exposed by applying an analytical method, studying the provisions of Laws 04/18 and 23/05 relevant to the prevention and repression of drug offenses, with the occasional use of a comparison approach when comparing the provisions of both laws.
