مكانة النظام العام في أحكام النفقة المؤقتة

الملخص
تعتبر النفقة المؤقتة من بين الدعاوي الإستعجالية الأكثر انتشاراً على أروقة المحاكم، وذلك لما لها من أهمية كبيرة في تحقيق الأستقرار النفسي والمالي للأسرة خلال فترة نشوب النزاع، خاصةً في حالة وجود أطفال قُصَرْ ليست لهم قدرة على الكسب،فهي دعوى تقوم على عنصرين أساسين (عنصر الإستعجال، وعدم المساس بأصل الحق) وهما في نظر فقهاء القانون من النظام العام، فعنصر الاستعجال يقتضي قيام حالة الضرورة وحاجة الزوجة والأطفال الــمُلِحة للنفقة، أما عدم المساس بأصل الحق فيقتضي أن تكون النفقة المؤقتة غير دائمة محددة بفترة معينة إلى غاية الفصل في موضوع الدعوى. يهدف هذا المقال إلى بيان أهمية النفقة المؤقتة في حياة الأسرة من خلال الدعاوي الإستعجالية، والتي تهدف إلى تحقيق مقاصد مُعْتَبَرةٌ شرعاً وقانوناً منها حماية النفس فهي أحد الكليات الخمس التي جاءت الشريعة الإسلامية لحفظها،معتمدين في ذلك على إبراز مكانة النظام العام وتحديد نطاقه من خلال الجوانب الموضوعية والإجرائية التي جاء بها المشرع الجزائري في قانون الأسرة وقانون الإجراءات المدنية والإدارية. summary: The temporary alimony is among the urgent cases the most prevalent in the corridors of the courts, because of its great importance in achieving the psychological and financial stability of the family during the breakthrough period, especially in the case of the presence of minor children who have no ability to earn, it is a lawsuit based on two basic elements (element Using, and not to prejudice the origin of the right), which are in the eyes of the jurists of the law from the public order. This article aims to explain the importance of temporary alimony in the life of the family through urgent cases, which aims to achieve the purposes of Sharia and law, including self -protection, as it is one of the five colleges that Islamic law came to preserve, relying on this to highlight the position of public order and determine its scope through aspects The objectivity and procedural that the Algerian legislator came to the Family Law and the Civil and Administrative Procedures Law.
