اشكالات تنفيذ أحكام النفقة في ظل قانون النفقة 24-01 في الجزائر

الملخص
يتناول هذا المقال إشكالات تنفيذ أحكام النفقة في الجزائر في ظل القانون رقم 24 01 المتضمن تدابير خاصة للحصول على النفقة، بعد إلغاء قانون 15 01 المتعلق بصندوق النفقة. يهدف البحث إلى تحليل الإطار القانوني والتنظيمي الجديد، وبيان مسار تنفيذ أحكام النفقة قبل وبعد صدور القانون، مع التركيز على المستحقات المالية وآليات تدخل الدولة لضمان وصولها إلى المحضون والمطلقة الحاضنة. كما يعالج المقال أهم العراقيل الإجرائية والواقعية، مثل تعقيد الملف، بطء دراسة الطلبات، قصور الربط المعلوماتي، وصعوبات تتبّع المدين في ظل انتشار الاقتصاد غير المهيكل. ويتناول أيضاً الآثار الاجتماعية والاقتصادية لتعثر التنفيذ على الفقر الأسري، والعنف الاقتصادي ضد المرأة، وهشاشة أوضاع الأطفال المحضونين، لينتهي إلى اقتراح جملة من الحلول التشريعية والقضائية والإدارية والجزائية، في إطار رؤية شمولية لتعزيز فعالية قانون 24 01 وحماية الأسرة. Summary: This article discusses the problems of implementing alimony provisions in Algeria under Law No. 2401, which includes special measures to obtain alimony, following the repeal of Law 1501 on the alimony fund. The research aims to analyze the new legal and regulatory framework, and to explain the path of implementation of alimony provisions before and after the issuance of the law, with a focus on financial dues and the mechanisms of state intervention to ensure that they reach the custodian and the divorced custodian of custody. The article also addresses the most important procedural and factual obstacles, such as the complexity of the file, the slow study of applications, the lack of information linkage, and the difficulties of tracking the debtor in light of the spread of the informal economy. It also addresses the social and economic effects of the stalled implementation on family poverty, economic violence against women, and the vulnerability of children in foster care, and concludes with a number of legislative, judicial, administrative and penal solutions, within the framework of a comprehensive vision to enhance the effectiveness of Law 2401 and protect the family.
