الملخص

ملخص: يعد الأسر من أشد العقوبات التي قد يتعرض لها الإنسان، فيفقد بموجبه أهم مقومات الحياة الانسانية وهو الحرية، ويعيش الاسير فيه الهموم والمعاناة الدائمة سواء من ناحيه مصيره أو أهله وولده. ولهذا لم يترك الإسلام التعامل مع أسرى الحروب بدون ضوابط شرعية تقيد التعامل معهم، فنصت الشريعة الاسلامية على مجموعة من القواعد التي تحدد للمسلمين الطرق الصحيحة التي يجب اتباعها في التعامل مع الأسرى حتى تمنع عنهم الظلم والتعدي. وهذه الدراسة تناقش الضوابط الشرعية للتعامل مع الأسرى وبعدها المقاصدي. ومن خلال هذه الدراسة خلصنا لمجموعة من النتائج يمكن إجمالها فيما يلي: أن الشريعة الإسلامية غايتها في كل الأحوال تحصيل أكبر قدر من المصالح، وجاءت الشريعة الإسلامية بمجموعة من القواعد التي تضبط التعامل مع أسرى الحرب وتحفظ حقوقهم، ومن أهم المقاصد التي تثمرها المعاملة الحسنة للأسرى: الحفاظ على مقاصد الشريعة، وتأكيد محاسن الإسلام من السماحة والرحمة والتعايش السلمي وتأليف قلوب الأسرى وتحبيبهم في الدين الإسلامي. Captivity is considered one of the most severe punishments that a person may be subjected to, as he loses the most important basics of human life, which is freedom, and the prisoner lives in constant worries and suffering, whether in terms of his fate or the fate of his family and children. This is why Islam does not leave dealing with prisoners of war without legal controls that restrict it. Islamic law indicates a set of rules that specify for Muslims the correct methods that must be followed in treating them in order to prevent them from injustice and transgression. This study discusses the legal rules for dealing with prisoners and their objective dimensions. We have reached a set of results that can be summarized as follows: Islamic law aims to achieve the greatest possible benefits. Islamic law came with a set of rules that regulate dealing with prisoners of war and preserve their rights. Among the most important objectives that result from good treatment of prisoners are: preserving the objectives of Sharia law, and affirming the virtues of Islam such as tolerance, mercy, and peaceful coexistence, and bringing the hearts of prisoners together and making them love to the Islamic religion
