الأمن القانوني ... بحث في المفهوم والأسس

الملخص
يعتبر الأمن القانوني من بين أهم المبادئ التي تقوم عليها الدولة الدستورية، حيث ينطوي المبدأ على تحقيق الاستقرار النسبي للقوانين وجودة المادة القانونية، بما يضمن حماية لحقوق الأفراد والمتعاملين، ويحقق حركة تنموية ويستقطب الاستثمار الأجنبي، ومن تم سعت الكثير من الدول إلى دسترة المبدأ اعترافا منها بالقيمة الدستورية له، والتي تمنحه حصانة وحماية أفضل، وسنحاول من خلال هذه الورقة البحثية الإلمام بمفاهيم الأمن القانوني وتحديد أسسه وضوابطه. Legal security is considered one of the most important principles on which the constitutional state is based, as the principle involves achieving relative stability of laws and the quality of the legal material in a way that guarantees the protection of the rights of individuals and stakeholders, which achieves development and attracts foreign investment. Therefore, many countries have sought to constitutionalize the principle in recognition of the constitutional value of the principle, which grants it better immunity and protection. Through this research paper, we will try to understand the concepts of legal security and determine its foundations and controls.
