The Legal Status Of Individual Combatants In Times Of Armed Conflict

الملخص
Abstract The existence of armed conflict necessarily leads to a multiplicity of combat groups. which often makes it difficult to determine the legal status of certain groups involved in hostilities, Especially when caught in the suspicion circle by some individuals, it is difficult to distinguish between fighter and civilian on the one hand The distinction between a legitimate combatant and an illegal combatant, on the other hand, There is a profession of mercenaries from the fighting. s role in hostilities and thus poses the problem of the extent to which these groups enjoy international legal protection. In order to determine the legal status of these persons, we try to identify the legal concept and framework of both the legal Combatant and the illegal Combatant. الملخص إن قيام النزاع المسلح يؤدي بالضرورة الى تعدد الفئات المقاتلة، الامر الذي يصعب في أغلب الأوقات تحديد الوضع القانوني لبعض المجموعات المشاركة في الأعمال الحربية، فيصعب التمييز بين المقاتل و المدني من جهة، والتمييز بين المقاتل الشرعي و المقاتل غير الشرعي من جهة اخرى، اذ ان هناك من يتخذ من عملية القتال مهنة يتكسب منها كالمرتزقة، ناهيك عن ما للجاسوس من دور في العمليات العدائية و بالتالي يطرح إشكال مدى تمتع هذه الفئات بالحماية القانونية الدولية. و للوقوف على المركز القانوني لهؤلاء الاشخاص نحاول التطرق الى تحديد المفهوم و الاطار القانوني لكلا من المقاتل الشرعي و المقاتل غير الشرعي .
