Abstract

Electronic evidence has acquired a pivotal status within the domain of criminal proof, particularly in light of the proliferation of offences of an electronic and cyber-criminal nature. Comparative criminal legislations have endeavored to delineate the modalities for the admissibility and use of such evidence in the service of criminal investigations, a trend also embraced by the Algerian legislator. This regulatory framework integrates both substantive and procedural dimensions, notably with regard to the modalities governing the use of electronic optical devices, as well as through the establishment of the so-called National Criminal Division for Combating Offences Related to Information and Communication Technologies, introduced pursuant to the Algerian Code of Criminal Procedure.
