Abstract: All countries, through their domestic legislation, strive to regulate the labor market to ensure sustainable development and keep pace with market demands, thereby achieving prosperity and economic profit. However, this must be done without infringing upon the rights of the wealth-creating segment of society: the working class. This can only be achieved through a legally binding contract that guarantees the rights and obligations of both parties, under a formal legal framework. Most legal systems have sought to achieve this, and the Algerian legislature, through Law 90/11 regulating employment relationships, has also attempted to establish a set of controls aimed at ensuring the stability and continuity of the employment relationship. This relationship, governed by the employment contract, must adhere to a set of substantive and formal conditions that guarantee the validity and integrity of the contract, thus safeguarding the rights and obligations of both parties: the employer and the employee.
