The Limits Of Legal Security In The Economic Real Estatemanagement: A Critical Study In Light Of Law No. 23-17

Abstract
Abstract: This study seeks to delineate the boundaries of legal security within the system of managing economic real estate in Algeria, in light of Law NO:23_17 of 15 November 2023, as the new legislative framework governing the allocation of real estate concessions for investment purposes. The research aims to explore the extent of effectiveness of this newly introduced framework in providing a stable and attractive investment environment, through balancing the formal guarantees it enshrines with the practical challenges that may hinder its effectiveness Relying on the analytical method, the study examines the new mechanisms for granting concessions, the guarantees granted to investors, as well as the discretionary powers of the administration in monitoring and terminating contracts. The findings conclude that although the law represents a qualitative step in the reform of economic real estate, the achievement of actual legal security remains contingent upon limiting administrative discretion, ensuring effective judicial oversight, and maintaining long-term legislative stability. Keywords: Legal certainty, Economic real estate, Law 23-17, Investment, Concession. ملخص سعت الدراسة إلى تحديد حدود الأمن القانوني في منظومة تسيير العقار الاقتصادي في الجزائر على ضوء القانون 23_17 المؤرخ في 15 نوفمبر 2023، باعتباره الإطار التشريعي الجديد المنظم لعمليات منح الامتياز العقاري الموجه للاستثمار، تهدف الدراسة إلى استقصاء حدود فاعلية هذا الإطار التشريعي المستحدث في توفير بيئة استثمارية مستقرة وجاذبة للمستثمرين، من خلال الموازنة بين الضمانات الشكلية التي كرسها، التحديات العملية التي قد تحول دون فعاليته، وصلاحيات الإدارة في الرقابة وإنهاء العقد. اعتمدت الدراسة المنهج التحليلي في استقراء النصوص، وخلصت إلى أن القانون شكل نقلة نوعية في مسار إصلاح العقار الاقتصادي، غير ان تحقيق الأمن القانوني الفعلي يبقى رهينا بمدى تقييد تدخل الإدارة، وضمان فعالية الرقابة القضائية واستقرار المنظومة التشريعية على المدى الطويل. الكلمات المفتاحية: الأمن القانوني، العقار الاقتصادي، قانون 23_17، الاستثمار، الامتياز.
