Real estate seizure constitutes a key judicial enforcement mechanism within Algerian law, governed by a structured legal framework established under the Code of Civil and Administrative Procedures. It is strictly conditioned by procedural safeguards aimed at balancing creditors’ rights with the protection of debtors’ property. These include the requirement of an enforceable title, formal debtor notification, seizure registration at the (Conservation Foncière), and public auction under judicial supervision. Despite this clear normative framework, practical implementation faces persistent challenges such as administrative delays, inefficiencies in property registration, procedural formalism, and limited protection of vulnerable debtors, especially regarding primary residences. These issues reflect broader tensions between legal texts and enforcement realities. Addressing them requires institutional reforms, including procedural simplification, modernization of real estate registries, and introduction of alternative enforcement mechanisms. By highlighting both legal foundations and operational difficulties, the study underscores the need for a more balanced and effective enforcement system in Algeria
