Abstract
الملخص: تعد جرائم التزوير واستعمال المزور من المواضيع الهامة في الوقت الراهن، بالنظر لتفشي واستفحال هذه الجريمة التي تهدف إلى زعزعة الثقة العامة وتغيير الحقيقة ومنح مزايا لغير مستحقيها في الواقع، مما أدّى إلى صعوبة الكشف عن هذه الجرائم وكذا صعوبة إثباتها،وهذا ما دفع بالمشرع الجزائري لإلغائها من قانون العقوبات وإصدار القانون الجديد 24-02 المتعلق بمكافحة التزوير واستعمال المزوّر؛ الذي يحتوي على أحكام خاصة بالتجريم والعقاب بما يوائم الواقع وما هو موجود عمليا، من خلال تجريم بعض الأفعال المستحدثة التي لم تكن مجرّمة في قانون العقوبات، واعتماده على سياسة مشددة في التصدي لهذه الجرائم. Abstract: Crimes of forgery and the use of forged documents are among the most significant issues today, given the growing prevalence of this phenomenon, which aims to undermine public trust, alter the truth, and grant benefits to those who do not deserve them. This has made the detection and proof of such crimes increasingly difficult. Consequently, the Algerian legislator repealed the relevant provisions from the Penal Code and enacted the new Law No. 24-02 on combating forgery and the use of forged documents. This law introduces specific provisions on criminalization and punishment that better reflect current realities and practical circumstances by criminalizing certain newly emerging acts that were not previously addressed in the Penal Code, while adopting a stricter policy to confront these crimes.
