الملخص
الملخص: تعتبر الدعوى العمومية الوسيلة القانونية التي خوّلها المشرع الجزائري للنيابة العامة لتطبيق السياسة الجزائية للدولة بما يضمن تحقيق الردع الجنائي، من خلال الإعتماد على قانون الإجراءات الجزائية 25/ 14 الذي ينظم طرق السير فيها، ونجد أنّ هذا القانون عمل على توسيع صلاحية النيابة العامة في تقرير مصير الدعوى العمومية؛ الموضوع الذي يهدف إلى تبيان الآليات التي تعتمد عليها النيابة العامة في ملائمة الدعوى العمومية؛ سواء كان ذلك من خلال تحريكها ومباشرتها وهذا في حالة عدم حفظها؛ أين استحدث طرق جديدة لتحريك الدعوى العمومية تهدف لتحقيق السرعة في الإجراءات واستفادة المتهم من ظروف تخفيف التي يستخدم فيها وكيل الجمهورية صلاحيات واسعة تتعلق حتى باتخاذ بعض الإجراءات التحفظية لضمان حسن سير البحث والتحري عن الجرائم. أو اللجوء إلى آليات بديلة عن الدعوى العمومية، تقوم على تكريس العدالة التصالحية ومعالجة الآثار المترتبة عن الجريمة، من خلال جبر الضرر وتحقيق التوازن بين مصلحة المجتمع وحقوق الأطراف. Abstract: The public prosecution constitutes the legal mechanism through which the Algerian legislator empowered the Public Prosecution Office to implement the State’s criminal policy and ensure criminal deterrence, pursuant to Criminal Procedure Law No. 14/25 regulating its procedures. This law expanded the powers of the Public Prosecution Office in determining the fate of public prosecution through mechanisms aimed at adapting criminal proceedings, whether by initiating and conducting them or by deciding not to proceed. It also introduced new procedures intended to accelerate criminal proceedings and allow the accused to benefit from mitigating circumstances, while granting the Public Prosecutor broad powers, including the adoption of precautionary measures to ensure the effectiveness of investigations. Furthermore, the law established alternatives to public prosecution based on restorative justice, through damage reparation and the achievement of balance between societal interests and the rights of the parties. .
