المسؤوليّة المدنيّة عن أضرار استخدام تقنيّات الذّكاء الاصطناعيّ في التّشريع الجزائريّ -دراسة تحليليّة-

الملخص
يشهد العالم اليوم تحدي كبير وصراع قائم بين والذكاء البشري الذكاء الاصطناعي، فبات هذا الأمر يؤرق الجميع ذلك أن هذه الأخيرة اكتسحت جميع الميادين دون الحاجة للإنسان. فأصبحت تقنيات الذّكاء الاصطناعيّ من أهم ميزات هذا العصر ، غير أن المخاطر التي تحدثها هذه المنظومة بات من الضروري الوقوف على قيام المسؤولية القانونية في حالة التسبب في أضرار للغير، وما مدى ملائمة قواعد المسؤولّية المدّنية عن الأضرار التي تسببها هذه التقنية عند المشرع الجزائري وتشريعات أخرى. تهدف هذه الورقة البحثية لدراسة مسألة قانونية مستجدة نابعة عن تطور تقنيات الذّكاء الاصطناعيّ، التي تحاكي الانسان تصرفاته، وأحيانا تقوم مقامه. وفي أغلب الأحيان ترتكب أضرار نتيجة لوجود خلل في هذه التقنيات أخطاء. ظل عدم تحديد الشخص المسؤول عن الأضرار التي تتسبب فيها تقنيات الذّكاء الاصطناعيّ والفراغ القانوني في قيام المسؤولّية المدّنية، حاولت هذه الدراسة البحث تحليل قواعد مسؤولّية المدّنية في التشريع الجزائريّ والنظر في قواعد المسؤولية المدّنية. Today, the world is witnessing a major challenge and a conflict between human intelligence and artificial intelligence. This matter has become a concern for everyone, as the latter has swept all fields without the need for humans. Artificial intelligence technologies have become one of the most important features of this era, but the risks caused by this system have made it necessary to stand on the establishment of legal responsibility in the event of causing harm to others, and the extent of the suitability of the rules of civil liability for damages caused by this technology in the Algerian legislator and other legislations. Cet article de recherche vise à examiner une nouvelle problématique juridique liée au développement des technologies d'intelligence artificielle qui imitent le comportement humain, voire le remplacent parfois. Ces technologies sont souvent à l'origine de préjudices dus à des dysfonctionnements et des erreurs. Face au manque de clarté concernant la responsabilité pour les dommages causés par les technologies d'intelligence artificielle et au vide juridique qui entoure la responsabilité civile, cette étude analyse les règles de responsabilité civile en droit algérien et examine les principes qui la sous-tendent.
