الملخص
ملخص: حاول المقال بحث طبيعة المُـقاربة التي أعطاها القانون الجزائري لمكانة الصحفي في المجتمع، وذلك نظرا لما يحمله من غاية كبرى، تتمثل في إيصال الرسائل التوعوية للجمهور، المؤسسة على مبدأ إرساء حرية التعبير والنقد في قالب قانوني، يتجلى ذلك بإصدار القانون العضوي الجديد رقم (23-14 المؤرخ في 27 غشت سنة 2023، المتعلق بالإعلام، الصادر في ج ر ج ج، العدد 56، بتاريخ 29 غشت سنة 2023م). غير أن القانون لا يعفيه من المسئولية المدنية، إذا خالف ضوابط المهنة بالتعدي على الحياة الخاصة للأشخاص، ولم يتفادى السب والقذف والإهانة وكل ما من شأنه المساس بأمن الدولة. ومن آثار المسئولية المدنية أن أي شخص يدعي أنه قد تضرر من فعل صحفي ما يحق له رفع دعوى قضائية للمطالبة بالتعويض لجبر ضرر أصابه، بشرط أن يكون الضرر محققا ومباشرا ومنتجا، كما نصت المادتين (124 و 182 من ق م ج). Abstract: The article attempts to examine the nature of the approach that Algerian law gives to journalists, due to their major objective, which is to deliver public awareness messages, based on the principle of establishing freedom of expression and criticism within a legal framework. This is reflected in the promulgation of the new Organic Law (No. 23-14 of August 27, 2023, relating to the media, published in the O.J.R.A, No. 56, of August 29, 2023 AD). However, the law does not exempt journalists from civil liability if they violate professional regulations by invading people's privacy, nor does it prevent insults, defamation, slander, or anything that could harm state security. One of the effects of civil liability is that anyone who claims to have been harmed by an act of a journalist has the right to bring a legal action to claim compensation for the harm they have suffered, provided that this harm is real, direct, and productive, as provided for in Articles (124 and 182 of the A.C.C)
