تَدخُّل الحُكومة في الاختصاص التشريعي للبرلمان الجزائري على ضوء التّعديل الدستوري لسنة 2020-government Intervention In The Legislative Jurisdiction Of The Algerian Parliament In Light Of The 2020 Constitutional Amendment

الملخص

تهدف الدراسة إلى تحديد أثر تعديل الدستور الجزائري لسنة 2020 على العلاقة بين الحكومة والبرلمان، والكشف عن مجالات التعاون الوظيفي المتبادل فيما بينهما، لاسيما من حيث إعداد النصوص القانونية والتصويت عليها وكذا تنفيذها. اعتمدت الدراسة على المنهج الوصفي-التحليلي باعتباره المنهج الأنسب لوصف كيفيات تنظيم العلاقات الوظيفية بين غرفتي البرلمان والحكومة، وسير مسار إجراءات إعداد القوانين والتصويت عليها، بالإضافة إلى تحليل النصوص القانونية ذات الصلة، واستنتاج كافة الآثار والنتائج المترتبة عنها. خلصت الدراسة إلى النتائج الآتية: هيمنة الحكومة على الاختصاص التشريعي للبرلمان – إعادة تنظيم العلاقة داخل السلطة التنفيذية - خضوع التنظيمات المستقلة للرقابة الدستورية والدفع بعدم الدستورية من قبل المحكمة الدستورية – دسترة مبدأ الأمن القانوني وتكريسه عن طريق دليل إعداد النصوص القانونية. The study aims to determine the impact of the 2020 Algerian constitutional amendment on the relationship between the government and parliament, and to reveal the areas of mutual functional cooperation between them, particularly in terms of drafting, voting on, and implementation of legal texts. The study adopted the descriptive-analytical approach, as it is the most appropriate for describing how functional relationships between the two chambers of parliament and the government are organized, and the process of drafting and voting on laws. Additionally, it analyzed relevant legal texts and deduced all resulting effects and outcomes. The study concluded with the following results: The government's dominance over the parliament's legislative jurisdiction – Reorganization of the relationship within the executive authority – Subjection of independent regulations to constitutional oversight and the plea of unconstitutionality by the Constitutional Court – Constitutionalization of the principle of legal security and its institutionalization through a guide for drafting legal texts.
