الرقابة الإدارية على إجراءات نزع الملكية من أجل المنفعة العمومية في مجال إنجاز المشاريع ذات البعد الوطني والاستراتيجي-administrative Control Over Expropriation Procedures For Public Utility In The Completion Of Infrastructure Of National And Strategic Dimension

الملخص
تهدف الدراسة إلى معرفة أثر تعديل قانون نزع الملكية في سنة 2005 على إجراءات نزع الملكية في مجال إنجاز المشاريع ذات البعد الوطني والاستراتيجي، والكشف عن طرق الرقابة على هذه الإجراءات من حيث هيئات الرقابة وكيفيات مُمارستها. اعتمدت الدراسة على المنهج الوصفي-التحليلي باعتباره الطريقة الأنسب لوصف كيفيات تنظيم هيئات الرقابة المختلفة وسير مسار الرقابة على إجراءات نزع الملكية، وكذا تحليل البيانات الأولية المتحصل عليها على غرار النصوص التشريعية والتنظيمية، والقرارات الإدارية، واستنتاج كافة الآثار والنتائج المترتبة عنها. خلصت الدراسة إلى النتائج الآتية: التصريح بالمنفعة العمومية يتم بموجب مرسوم تنفيذي – الحيازة الفورية على الأملاك والحقوق العينية العقارية بعد إيداع مبلغ التعويض لدى الخزينة العمومية – الطعون القضائية لا توقف تنفيذ إجراء الحيازة الفورية - الطعون القضائية لا توقف تنفيذ نقل الملكية لصالح الدولة. The study aims to know the impact of amending the expropriation legislation for public Utility of 2005 on expropriation procedures in the completion of infrastructure of national and strategic dimension, and to reveal methods of monitoring these procedures in terms of oversight organisms and how to practice them. The study relied on the descriptive-analytical approach, as it is the most appropriate method to describe how the various oversight organisms are organized and the course of oversight of expropriation procedures, as well as analyzing the primary data obtained such as legislative and regulatory texts and administrative decisions, and deducing all the effects and consequences resulting from them. The study concluded the following results: Declaration of public Utility is made pursuant to an executive decree - Immediate possession of property and real estate rights after depositing the compensation amount in the public treasury - Judicial appeals do not stop the implementation of the immediate possession procedure - Judicial appeals do not stop the implementation of the transfer of ownership in favor of the state.
