With the rapid advancement of internet and computer technologies across the globe, a new category of crime has emerged—cybercrime—which now poses a threat no less serious than traditional criminal activity. These offenses are notoriously difficult to detect and prove due to their occurrence in a dematerialized digital realm. Recognizing this danger, Algerian legislation, like many other legal systems, enacted Law No. 09-04 on offenses against automated data processing, and amended the Penal Code accordingly by introducing Articles 394 bis to 394 bis 7. Despite these efforts, investigative authorities still face significant challenges in gathering tangible and admissible evidence in cybercrime cases. شهد العالم، نتيجة للتطور المتسارع في مجال الإنترنت والحواسيب، ظهور نمط جديد من الجرائم يُعرف بالجرائم الإلكترونية، والتي لا تقلّ خطورة عن الجرائم التقليدية، بل تتسم بصعوبة اكتشافها وإثباتها نظراً لطبيعتها غير المادية وارتكابها في بيئة رقمية مجردة من الوثائق والمستندات. وقد تنبّه المشرع الجزائري إلى خطورة هذه الجرائم، فأصدر القانون رقم 09-04 المتعلق بالجرائم الماسة بأنظمة المعالجة الآلية للمعطيات، كما عدّل قانون العقوبات بإضافة المواد من 394 مكرر إلى 394 مكرر 7. ورغم هذه المبادرات التشريعية، لا تزال سلطات التحقيق تواجه تحديات كبيرة في إثبات الجرائم الإلكترونية بأدلة ملموسة تُضاهي تلك المستخدمة في الجرائم التقليدية.
