Evidence in criminal matters is a cornerstone of criminal justice, enabling the judge to form a conviction about the occurrence of the offence and its attribution to the accused. The lawfulness of evidence concerns not only its content but also the manner of its acquisition: evidence derived from an unlawful procedure raises questions about its admissibility. The Algerian legislator—through the 2020 Constitution and Code of Criminal Procedure No. 25-14 of 2025 has affirmed the need to respect legal safeguards during evidence-gathering, particularly in electronic investigations and digital searches, in order to protect private life and ensure lawful proof. Although there is no explicit provision on this precise issue, the general rules of criminal procedure, rooted in the Constitution, implicitly indicate that evidence obtained in breach of the law cannot be relied upon. The judge’s freedom to assess evidence, though broad, is constrained by the requirement that means of proof be lawfully collected. Legal thought has developed the principle of causal independence of evidence, under which the nullity of a procedure does not necessarily entail nullity of the resulting evidence unless the latter is the direct product of the void act; where the causal link can be severed, the evidence is lawful in itself. Algerian law thus seeks a careful balance between safeguarding individual freedoms and ensuring the effectiveness of criminal justice. Nonetheless, it remains necessary for the legislator to enact clear provisions governing the admissibility of evidence derived from unlawful procedures, in order to unify judicial practice and consolidate legal certainty
