Unfair Commercial Practices Under Algerian Law

Authors : Laksaci Sid Ahmed .

Abstract

Competition law is considered a relatively modern form of legislation that emerged in developed countries adopting a market economy and pursuing economic development. With the expansion of commercial exchanges, particularly in light of the emergence of competitors employing misleading methods such as commercial fraud, trademark imitation, and the dissemination of rumors that harm the reputation of competitors, as well as attracting customers through unlawful inducement or exploiting the commercial reputation of others, the phenomenon of unfair competition has become increasingly evident. This situation has required the legislator to intervene in order to protect competition, competitors, and consumers simultaneously. Such protection is ensured through the establishment of strict legal rules and provisions aimed at combating these practices, as well as prohibiting behaviors that constitute abuse and disrupt the balance of commercial relations among competitors within the market
