The Legal Liability For Digital Interaction With Cyberbullying Content: A Comparative Study

Authors : Chikhi Nebia .

Abstract

Interaction with cyberbullying posts -whether through likes, comments, or shares- raises a legal issue regarding the extent to which such acts constitute participation in cyberbullying or merely an expression of opinion. These interactions may be seen as encouraging or implicitly approving offensive content, potentially resulting in legal liability through secondary participation or indirect complicity. Conversely, they may reflect an exercise of freedom of expression, particularly when there is no intent to cause harm. Thus, the legal assessment of these actions depends on their nature and underlying intent, highlighting the need for clear legislative frameworks to define the boundary between legitimate use of digital platforms and involvement in the dissemination of cyberbullying content.
