The Impact Of The Judicial Nature Of The Administrative Judge In Fostering Justice And Creating Administrative Law Rules أثر الطبيعة الإنشائية للقاضي الإداري في تكريس العدالة وخلق قواعد القانون الإداري

Abstract
The administrative judge enjoys considerable autonomy and independence in crafting appropriate solutions to legal issues arising in the realm of public law, particularly in the interactions between the administration, when managing public services, and individuals. The judge has the discretion to apply legal norms that correspond to these relationships and may adapt these norms to ensure greater alignment. Furthermore, the administrative judge plays a crucial role in the formation of administrative law, sometimes surpassing the legislature in this capacity. Consequently, when the judge formulates judicial principles that regulate the discretionary powers granted to the administration, they effectively oversee these powers, acting as a judge of discretion, all while ensuring no conflict arises between this discretion and the pursuit of justice يتمتع القاضي الإداري بحرية واستقلالية في ابتداع الحلول المناسبة للروابط القانونية التي تنشأ في مجال القانون العام بين الإدارة في قيامها على المرافق العامة وبين الأفراد، فله أن يطبّق القواعد القانونية ما يتلاءم معها، وله أن يطوّرها بما يحقق هذا التلاؤم؛ كما يمارس القاضي الإداري دورا فعالا في إنشاء قواعد القانون الإداري، قد يفوق في ذلك دور المشرع. ومن نتائج ذلك أن القاضي عندما ينشئ القواعد القضائية التي تضبط حرية الملاءمة الممنوحة للإدارة، فإنه يباشر رقابته على هذه الحرية كقاضٍ للملاءمة، دون أن يكون هناك تعارض بين هذه الحرية وتكريس العدالة. .
