Civil Liability For Damages Caused By Artificial Intelligence Systems A Comparative Analytical Study

Authors : Bekka Hassene .

Abstract

Recent advances in artificial intelligence (AI) technologies have led to the emergence of numerous practical applications capable of self-learning and autonomous decision-making in response to their surrounding environment. Among the most prominent of these applications are robots, autonomous vehicles, and unmanned aerial vehicles (drones). These technologies have generated significant benefits in various fields, including economic, medical, and military sectors, thereby fostering development and enhancing overall efficiency. However, the impact of AI systems is not confined to their positive outcomes. Their autonomous operation may also give rise to physical or material damage affecting individuals or property. This reality raises complex legal questions regarding the scope of civil liability arising from the use of AI systems. In particular, it necessitates an examination of the legal foundations of such liability, the conditions for its establishment, the mechanisms for proving damage and causation, as well as the available methods for compensating harm resulting from the actions of AI systems. This study adopts a comparative analytical approach to assess the adequacy of traditional civil liability regimes in addressing damages caused by artificial intelligence systems, while exploring the need for adapted or innovative legal frameworks capable of ensuring effective protection for victims and maintaining legal certainty.
