الحق في إبرام عقد الزواج مع ثبوت الموانع المرضية دراسة نقدية على ضوء أحكام المرسوم التنفيذي 24-366

الملخص
مـلخـص: في إطار الرعاية الصحية للأسرة، وحتى تضطلع بمهامها وأدوارها بشكلٍ إيجابي، يلتزم الطرفان طالبا الزواج بالخضوع لفحوص وتحاليل طبية قبل إبرام عقد الزواج وتحريره، بل هو بموجب النصوص التنظيمية إجراء إلزامي لتسجيل عقد الزواج مدنيا لدى ضابط الحالة المدنية. وفي إطار تحيين النصوص التنظيمية ذات الصلة؛ صدر مؤخرا المرسوم التنفيذي رقم 24 – 366 يتعلق بالشهادة الطبية والفحوص والتحاليل قبل الزواج، وهو الذي استهدفته ورقتنا البحثية بالتحليل والنقد؛ حيث استوقفتنا إشكالية حول الحق في الزواج مع ثبوت المانع الصحي المثبت بالفحص الطبي؛ أي مدى إلزامية نتائج الفحص الطبي خاصة إذا أثبتت المرض أو عامل خطر على صحة الطرفين طالبي الزواج، مع تمسكهما بحقهما في عقد الزواج ؟ مع تسجيل النتائج الرئيسية المتوصّل إليها. Abstract: In the context of family health care, and to ensure that it carries out its duties and roles positively, both parties seeking marriage are required to undergo medical examinations and tests before finalising and formalising the marriage contract. This is a mandatory procedure, according to regulatory texts, for the civil registration of the marriage contract with the civil status officer. In the process of updating the relevant regulatory texts, the executive decree No. 24-366 concerning the medical certificate and examinations before marriage was recently issued, which is the focus of our research paper for analysis and critique. We were confronted with an issue regarding the right to marry when a health impediment is confirmed by medical examination; that is, how obligatory are the results of the medical examination, especially if it confirms illness or risk factors to the health of both parties seeking marriage, while they insist on their right to marriage?
