مقاربة التكامل المعرفي والمنهجي في الدراسات المقارنة بين الشريعة والقانون

الملخص
ملخص: تحتل الدراسات المقارنة بين العلوم الشرعية والعلوم القانونية مكانتها من بين الدراسات المرتبطة بالعلوم الإنسانية؛ حيث تتفرّد بعدد من الخصائص التي تميّزها عن غيرها، وبالنظر إلى تقاطع هذه الدراسات في جوانب معرفية ومنهجية عديدة؛ فإنها تفتح المجال للباحثين والدارسين لتوجيه أعمالهم العلمية نحو الكشف عن وجوه التكامل المعرفي والمنهجي للدراسات المقارنة بين الشريعة والقانون إن من حيث التكوين والتأطير أو البحث العلمي الأكاديمي. في هذا الإطار، تستهدف هذه الدراسة الكشف عن ملامح التكامل والمعرفي في هذا النوع من الدراسات الذي يجمع بين فرعين من فروع العلوم الإنسانية وهي علم الشريعة الإسلامية وعلم القانون الوضعي وفق مقاربة معرفية ومنهجية، تنبني على مخطط بحثي محدد نتوصل بالتزامه إلى تسجيل أهم المخرجات الممكنة بهذا الصدد. Abstract: Comparative studies between Sharia sciences and legal sciences occupy their place among the studies related to the humanities, as they are unique in a number of characteristics that distinguish them from others, and given the intersection of these studies in many cognitive and methodological aspects, they open the way for researchers and scholars to direct their scientific work towards revealing the aspects of cognitive and methodological integration of comparative studies between Sharia and law, in terms of formation, framing or academic scientific research. In this context, this study aims to reveal the features of integration and knowledge in this type of studies, which combines two branches of the humanities, namely Islamic law and positive law, according to a cognitive and methodological approach, based on a specific research plan that we reach with its commitment to record the most important possible Résumé : Les études comparatives entre les sciences de la charia et les sciences juridiques occupent leur place parmi les études liées aux sciences humaines, car elles sont uniques par un certain nombre de caractéristiques qui les distinguent des autres, et compte tenu de l’intersection de ces études dans de nombreux aspects cognitifs et méthodologiques, elles ouvrent la voie aux chercheurs et aux universitaires pour orienter leurs travaux scientifiques vers la révélation des aspects de l’intégration cognitive et méthodologique des études comparatives entre la charia et le droit, en termes de formation, de cadrage ou de recherche scientifique universitaire. Dans ce contexte, cette étude vise à révéler les caractéristiques de l’intégration et de la connaissance dans ce type d’études, qui combine deux branches des sciences humaines, à savoir le droit islamique et le droit positif, selon une approche cognitive et méthodologique, basée sur un plan de recherche spécifique que nous atteignons avec son engagement à enregistrer les résultats les plus importants possibles à cet égard.
