The fluctuation in the use of terminology related to persons with disabilities reflects a deeper oscillation in the understanding of disability issues between the traditional protectionist approach and the modern rights-based approach. While the term "persons with special needs" represents the need for additional support for some groups, the term "people of determination" reflects a positive development at the psychological and social levels. While the term “persons with disabilities” refers to the actual reality of this group. Accordingly, this article seeks to examine the implications associated with the use of such terminology and to explore the reasons underlying this inconsistency, with the aim of identifying the most appropriate term for legal usage in order to safeguard the legal status of the concerned group. The analysis will be illustrated through reference to the prevailing approach within the Algerian legal system.
