الملخص
ملخص: تبحث هذه الدراسة في مدى قابلية المنظومة القانونية الجزائرية لتأطير توظيف الذكاء الاصطناعي في دعم الحوكمة البيئية المحلية داخل الجماعات الإقليمية. وتنطلق من فرضية مفادها أن التطور التقني الراهن يفرض تحديات تتجاوز جزئياً القواعد القانونية القائمة، ولا سيما فيما يتعلق بالقرار الخوارزمي، وتحديد المسؤولية، وحماية المعطيات، واعتمدت الدراسة المنهج الوصفي التحليلي مدعوماً بالمقارنة مع تجارب مختارة، من بينها الاتحاد الأوروبي وسنغافورة والإمارات، وتخلص إلى أن الجزائر تتوفر على مرتكزات دستورية وتشريعية أولية، غير أن الإطار الحالي لا يزال بحاجة إلى ضبط أدق يضمن الاستخدام المشروع والفعال للذكاء الاصطناعي في خدمة التنمية المحلية المستدامة. الكلمات المفتاحية: الذكاء الاصطناعي؛ التنمية المحلية المستدامة؛ الحوكمة الرقمية البيئية؛ الجماعات الإقليمية؛ المساءلة الخوارزمية؛ حماية المعطيات الشخصية Abstract: This study examines the extent to which the Algerian legal framework can regulate the use of artificial intelligence in supporting local environmental governance within territorial authorities. It proceeds from the assumption that current technological developments partly outpace existing legal rules, particularly with regard to algorithmic decision-making, the allocation of liability, and data protection. The study adopts a descriptive-analytical method, supported by a comparative approach drawing on selected experiences, including the European Union, Singapore, and the United Arab Emirates. It concludes that Algeria possesses initial constitutional and legislative foundations, but the current framework still requires more precise regulation to ensure the lawful and effective use of artificial intelligence in the service of sustainable local development.
