القواعد الحسان في تأصيل أحكام االلّعان

الملخص

يهدف هذا المقال إلى الإجابة عن أبرز الإشكالات والمعضلات المتعلّقة بأحكام اللّعنة ، التي ضلّت الأفهام بفساد تصوّرها، وزلّت الأقدام بسوء توظيفها، وما نجم عن ذلك من تكفير وتفسيق للواقعين في موجبات اللّعنات، ولهذا حاولت تحرير مصطلح اللّعنة تحريرا علميّا، وذلك عن طريق توظيف القواعد المتعارف عليها بين أهل العلم ، المتّسمة بالدقّة والتحقيق قصد الوصول إلى الحقّ، وتبرز إشكاليّة البحث حول ذكر أبرز أسباب تعارض النصوص الشرعيّة المتعلّقة بأحكام اللعنة، وماهي أهم القواعد التّأصيليّة الضابطة لأحكام اللّعان؟ وخلص البحث إلى أثر القواعد الأصوليّة في درء التعارض بين النصوص الشرعية المتعلقة بأحكام اللعنة، ومدى إسهاماتها في الفهم السليم لهذه النصوص الشرعيّة، والتوظيف المناسب لها في ضوء مقاصد الشّريعة من مراعاة الوسطيّة والاعتدال وتعظيم حرمات الله تعالى وغيرها من المقاصد المرعيّة المؤثّرة في تأصيل أحكام اللّعنة.This article aims to address the most prominent problems and dilemmas related to the rulings on cursing. These problems have led people astray due to their corrupted conception and misapplied inappropriately. This has resulted in the excommunication and declaring of those who fall under the responsibilities of cursing as infidels and heretics. Therefore, I have attempted to define the term "curse" scientifically, employing rules commonly accepted among scholars, characterized by precision and investigation, with the aim of arriving at the truth. The research problem arises from the most prominent reasons for the conflict between legal texts related to the rulings on cursing, and what are the most important fundamental rules governing the rulings on cursing? The research concludes by examining the impact of fundamental rules in preventing conflict between legal texts related to the rulings on cursing, the extent of their contribution to a sound understanding of these legal texts, and their appropriate application in light of the objectives of Sharia, including observing moderation and balance, honoring the sanctity of God Almighty, and other established objectives that influence the foundation of the rulings on cursing.
