تكريس القواعد الوقائية والعقابية لمكافحة المضاربة غير المشروعة(قراءة تحليلية لأحكام القانون رقم 21-15)

الملخص
جريمة المضاربة غير المشروعة التي استفحلت في واقعنا التجاري وخصوصا وأنها ارتبطت بالظروف الصحية الاستثنائية(جائحة كورونا)، وعملت على التأثير السلبي على الاستقرار الاقتصادي للدولة والمواطن والسوق، مما كان لازما ومحتما على المشرع الجزائري التدخل واخراجها من حيز قانون العقوبات والاقرار لها بنص خاص ينظم مسارها ألا وهو القانون رقم 21-15، بهدف فرض سلسلة من القواعد الناجعة والفعالة تميزت بين الوقاية والعقاب وتعزيز الأدوار واشراك المجتمع المدني والاعلام ومنظمة حماية المستهلك وتحديد المسؤوليات الجزائية، حيث تم الاقرار بمسؤولية الشخص الطبيعي والمعنوي على حد سواء، وهذا في سبيل الحفاظ على التنمية الاقتصادية وتوفير الحماية اللازمة للمستهلك، لكن تم التوصل أن مشكلتنا لا تكمن في فعالية النص القانوني ونجاعته في حد ذاته بل المشكلة تبرز في مدى الالتزام بتطبيق هذه القواعد الوقائية والردعية من الناحية الواقعية لأن أغلب هاته التدابير بقيت مجرد حبر على ورق. The crime of the unlawful speculation, rampant in our commercial sphere was associated with the exceptional health conditions (COVID-19 pandemic) and undermined the economic stability of the State, the citizen and the market; required and compelled the Algerian legislator to intervene and remove it from the scope of the Penal Code and to establish a special status governing its framework, namely Law No21-15, by enhancing a set of the effective rules marked by combining prevention and punishment, strengthening roles, involving the civil society, media and the Consumer Protection Organization, as well as defining the criminal liabilities, where both natural and legal persons were affirmed as being the subject to liability, in order to preserve the economic development and to provide the adequate consumer protection. However, it should be emphasized that the problem does not rooted in the efficiency or the adequacy of the legal provision itself that is at the fault, but the degree to which these preventive and punitive rules are observed in practice as the majority of these measures have persisted only on paper.
