Regulating Employment Relationships In Startups And Its Impact On Workers Rights

Authors : Merabet Habiba . Berrabah Houda .

Abstract

Employment relationships in startups are characterized by high flexibility and a departure from the traditional model, making them dynamic work environments. However, this flexibility can negatively affect workers’ rights. In many cases, clear contracts and regulatory frameworks are absent, leading to ambiguity in responsibilities, job instability, and a lack of social protection such as defined salaries, insurance, and holidays. These institutions also often lack union representation to safeguard employees’ interests. Nevertheless, some advantages may arise, such as rapid growth opportunities, participation in decision-making, and a work environment that fosters creativity and innovation. To ensure a balance between flexibility and the preservation of rights, it is essential for these institutions to clearly regulate contractual relationships, comply with labor laws, and provide a minimum level of social rights, thereby promoting a fair and sustainable work environment.
