Abstract : Collusive procurement is one of the most significant forms of anti-competitive practices that are widely spread in the world of bidding. Economic operators engage in secret agreements, away from the contracting party's will, to reduce competition and exclude competitors by rotating procurement contracts among themselves in a manner that violates the law. Pre-agreed candidates set the rules of the game. Various forms of collusion directly impact the economy. Legal loopholes and non-criminal texts regarding competitors' behaviors make it easy to manipulate public procurement contracts and award them to undeserving parties. Therefore, shedding light on all anti-competitive practices is necessary to criminalize actions leading to collusion. The findings of this study stress the necessity of dismantling entry barriers for new market players to invigorate competition and disband entrenched cartels. Additionally, the research capitalizes the efficacy of long-term supply contracts in mitigating recurrent interactions between firms, thereby discouraging collusive arrangements. Furthermore, strategic tender design emerges as an important mechanism wherein varying the number of contract items relative to potential bidders and accounting for disparities in market share, costs, and capabilities serve as critical deterrents against collusion. Ultimately, this study advocates for the imposition of stringent penalties as a robust legal deterrent against all manifestations of anti-competitive conduct in public procurement.
