سرقة البيانات الإلكترونية: دراسة تأصيلية مقارنة بين الأحكام الشرعية والقانون الجزائري

الملخص
يشكل تطور التقنية الرقمية بيئة خصبة لظهور جرائم مستحدثة، من أبرزها سرقة البيانات الإلكترونية، والتي تمس حقوق الأفراد والمؤسسات وتُهدد الأمن القانوني والرقمي. يستعرض هذا المقال مفهوم البيانات الإلكترونية وخصائصها، ويُحلل أبرز صور سرقتها.يناقش البحث موقف الفقه الإسلامي من هذه الجريمة، مركزًا على مدى انطباق شروط السرقة الحدية على الأفعال الرقمية، في المقابل، يستعرض المقال المعالجة القانونية الجزائرية عبر قوانين العقوبات والوقاية من الجرائم المعلوماتية، مع تحليل النصوص التي تُجرم الدخول غير المشروع، والتلاعب بالمعطيات، واختلاس البيانات. كما يُجري البحث مقارنة تحليلية بين الفقه الإسلامي والقانون الجزائري. The rapid advancement of digital technology has created a fertile environment for the emergence of new types of crimes, most notably the theft of electronic data, which infringes upon the rights of individuals and institutions and threatens both legal and digital security. This article examines the concept and characteristics of electronic data and analyzes the main forms of its theft. It explores the position of Islamic jurisprudence on this crime, focusing on the extent to which the conditions for the application of the hadd punishment for theft can be applied to digital acts In contrast, the article examines the legal treatment under Algerian law through criminal codes and cybercrime prevention legislation, with an analysis of the provisions that criminalize unauthorized access, data manipulation, and data misappropriation. The study conducts an analytical comparison between Islamic jurisprudence and Algerian law, highlighting points of agreement in criminalizing the act, as well as differences in its legal characterization and the conditions for establishing the crime. The research also emphasizes the need to address legal and jurisprudential gaps to keep pace with digital transformations and enhance data protection
