الحكومة في النظام الدستوري الجزائري: التعيين والبرنامج

الملخص
تعد الحكومة في النظام السياسي الجهاز التنفيذي لوضع السياسات العامة والمحافظة على حسن سير المرافق العامة وتنفيذ القوانين، ويوضع تحت تصرفها وسائل عديدة لتحقيق تلك الأهداف، وتعمل الحكومة تحت سلطة رئيس الجمهورية، ومراقبة السلطة التشريعية. تهدف الدراسة إلى تبيان المركز القانوني للحكومة في النظام الدستوري الجزائري، ودور رئيس الجمهورية في تنصيبها، بالإضافة إلى توضيح برنامج أو مخطط عمل الحكومة، وعلاقة الأغلبية الرئاسية أو البرلمانية بذلك. نستعمل المنهج التحليلي التركيبي والمقارن في بعض النقاط لتوضيح مركزها القانوني. وخلصنا إلى جملة من النتائج أهمها أن الحكومة في النظام الدستوري الجزائري مركزها ضعيف من حيث التعيين والبرنامج المعتمد ومسؤوليتها مزدوجة، دون تكون لها السلطة والصلاحيات لممارسة مهامها. The government, within the political system, constitutes the executive body responsible for formulating public policies, ensuring the proper functioning of public services, and implementing laws. It is endowed with various means to achieve these objectives and operates under the authority of the President of the Republic and the oversight of the legislative branch. This study aims to elucidate the legal status of the government within the Algerian constitutional system, the role of the President of the Republic in its appointment, the nature of the government’s program or action plan, and the relationship between this program and the presidential or parliamentary majority. The analytical-synthetic method is employed, supplemented by comparative analysis at certain points to clarify the government’s legal standing. The study concludes with several key findings, most notably that the government in the Algerian constitutional system holds a weak position regarding its appointment process, the adopted governmental program, and its dual accountability, without possessing sufficient authority or competences to effectively carry out its functions.
