التقنيات الحيوية الطبية الحديثة بين الفراغ التشريعي في الجزائر والتشريعات المقارنة

الملخص
يهدف هذا البحث إلى دراسة التقنيات الحيوية الطبية الحديثة باعتبارها من أبرز الابتكارات العلمية التي أثارت جدلا واسعا على المستويين الأخلاقي والقانوني، وينطلق البحث من تحديد الإطار المفاهيمي لهذه التقنيات، مع إبراز أهم تطبيقاتها وايجابياتها ومخاطرها، قبل الانتقال إلى مناقشة أبعادها الأخلاقية والدينية في ضوء الشريعة الإسلامية والمواثيق الدولية، كما يسعى البحث أساسا إلى الكشف عن مظاهر الفراغ التشريعي في الجزائر ومقارنته مع التشريعات المقارنة، وذلك قصد بناء تصور قانوني يوازن بين التطور العلمي والقيم الوطنية؛ وقد أظهرت نتائج البحث أن غياب إطار قانوني خاص في الجزائر يفتح المجال أمام مخاطر صحية وأخلاقية تهدد المجتمع، في حين أن بعض الدول وضعت آليات دقيقة للرقابة والضبط، وخلص البحث إلى ضرورة سن تشريع جزائري خاص يستفيد من التجارب المقارنة، مع مراعاة الخصوصيات الدينية والاجتماعية بما يحقق حماية الكرامة الإنسانية ويشجع البحث العلمي المسؤول. This research aims to examine modern medical biotechnologies as one of the most prominent scientific innovations that have sparked wide debate on both ethical and legal levels, the study begins by defining the conceptual framework of these technologies, highlighting their main applications, advantages, and risks, before addressing their ethical and religious dimensions in light of Islamic law and international conventions, the primary objective gap in Algerian concerning such practices and to compare the Algerian situation with selected foreign legislation, in order to propose a legal framework that balances scientific progress with national values ;The findings show that the absence of a specific legal framework in Algeria expose society to health and ethical risks, while other countries have adopted precise mechainisms of control and regulation, The research concludes with the necessity of enacting a dedicatrd Algerian legislation that draws upon comparative experiences while respecting religious and social particularities, thereby ensuring the protection of human dignity and promoting responsible scientific research.
