Abstract
Determination of working hours and rest periods, as well as mechanisms for their enforcement in accordance with legal texts, is one of the most important rights granted to workers in order to preserve their mental and physical health. However, the development of information and communication technologies in the field of work, which has led to the emergence of telework, requires the creation of a measure to protect workers from dangers of excessive use of digital domain under the name of the right to disconnection in order to guarantee the worker's right to rest outside working hours. يعد تحديد ساعات العمل وكذا مدد الراحة وآليات تطبيقها بموجب النصوص القانونية من أهم الحقوق الممنوحة للعمال بغرض الحفاظ على صحتهم العقلية والبدنية، غير أن تطور تكنلوجيات الاعلام والاتصال وما صاحبه من ادماج للتقنيات المرتبطة بها ضمن مجال العمل والذي أسس لظهور العمل عن بعد استدعى بالضرورة إيجاد آلية لحماية العمال من مخاطر الاستعمال المفرط للمجال الرقمي تحت مسمى حق قطع الاتصال من أجل ضمان حق العامل في الراحة خارج أوقات العمل.
