Abstract: The adoption of teleworking in public services has seen significant growth in recent years, driven by the digital transformation initiatives undertaken by numerous countries to enhance the quality of public service delivery. This shift was further accelerated by the global health crisis triggered by the COVID-19 pandemic, which underscored the critical need for legal and practical solutions to ensure the uninterrupted provision of public services during emergencies. As a result, telework emerged as a viable method of organizing public sector work, allowing employees to perform their duties remotely through the use of modern technologies, thereby maintaining operational continuity outside traditional workplace settings. However, while the implementation of teleworking offers numerous advantages and opportunities, it also presents significant challenges tied to the unique nature of public administration and public service. Public administration operates on fundamental principles such as continuity, equal access to services, adaptability, and the imperative to maintain the quality of services provided to users. At the same time, teleworking raises critical questions concerning employees' rights, including their right to privacy, the protection of their health and well-being, their entitlement to rest, and measures related to their security. Additionally, it introduces complexities regarding how compensation is determined—issues typically addressed within the framework of Public Employment Law. This study aims to emphasize the importance of adopting teleworking within the public sector by highlighting its critical role in addressing crises while safeguarding the fundamental principles of public administration. By analyzing the legal frameworks established in France to formalize this mode of work, the study examines how teleworking can ensure the continuity of public services and uphold the core values of public administration. The findings conclude that while teleworking represents a significant opportunity to modernize administrative practices and maintain service delivery during emergencies, its success depends on balancing the unique demands of public service with the rights and needs of employees, particularly in terms of privacy, well-being, and equitable working conditions.
