The Algerian legislator has codified the obligation of precontractual disclosure as a normative instrument to fortify consumer protection within consumption-based contractual relations. This legal duty compels the economic operator to furnish the consumer with all material particulars concerning the object of the contract. Amidst the globalization of economic exchanges and the ubiquity of the Internet as a transactional interface, remote contracting has become standard practice, even for mundane consumer activities. This evolution engenders profound legal ramifications, particularly the need for robust informational safeguards to counterbalance the structural vulnerability of the consumer. Given the consumer's inherent epistemic disadvantage, especially within digital commerce—where transactional dematerialization intensifies asymmetries—the obligation to disclose emerges as an indispensable corrective mechanism. It aims to bridge informational disparities and re-equilibrate contractual dynamics between consumers and electronic vendors.
Key words: Consumer – Economic Operator – Obligation – Disclosure – Electronic Commerce
