ضوابط استحقاق الأملاك العقارية الخاصة في إطار تدابير تشجيع الاستثمار

الملخص
ملخص: تعتبر الملكية العقارية الخاصة من الحقوق الدستورية الأساسية ، كونها تندرج في إطار حق الملكية بشكل عام و الذي تم النص عليه من قبل المؤسس الدستوري الجزائري ، حيث أشار في هذا الصدد أن الملكية الخاصة مضمونة ، حيث لا تنزع الملكية إلا في إطار القانون و بتعويض عادل و منصف .بحسب ما جاء في دستور 2020 . و في هذا الإطار و بهدف تحقيق مصالح عامة و غايات و أهداف تنموية ذات طابع اقتصادي و اجتماعي أجاز المشرع الجزائري استحقاق هذه الملكيات العقارية لصالح الدولة كمرحلة أولى قبل أن يتم نقل الانتفاع بها من جديد إلى كيانات قانونية أخرى من أجل تحقيق الأهداف و الغايات المذكورة أعلاه .، حيث أوكل هذا الدور للوكالة الجزائرية لترقية الاستثمار بتخويلها مهمة اكتساب لصالح الدولة كل عقار ذي ملكية خاصة يكون قابل لاحتضان مشروع استثماري ، و لكن ذلك بمراعاة جملة من الضوابط الموضوعية و الإجرائية . Private real estate ownership is considered one of the basic constitutional rights, as it falls within the framework of the right to property in general, which was stipulated by the Algerian constitutional founder, who indicated in this regard that private property is guaranteed, as ownership is not expropriated except within the framework of the law and with fair compensation and Fair. According to what was stated in the 2020 Constitution. In this context, and with the aim of achieving public interests and development goals and objectives of an economic and social nature, the Algerian legislator has permitted the entitlement of these real estate properties to the state as a first stage before the use of them is transferred again to other legal entities in order to achieve the goals and objectives mentioned above. This role was entrusted to the Algerian Investment Promotion Agency by authorizing it to acquire, for the benefit of the state, every privately owned property capable of embracing an investment project, but this is subject to a set of objective and procedural controls.
