الملخص
ملخص : يستلزم و يتطلب الانخراط و الاندماج في عملية التحول الرقمي ضرورة توفر جملة من المتطلبات المختلفة ذات الطبيعة السياسية و الهيكلية و المؤسساتية و التقنية والبشرية بالإضافة إلى المتطلبات القانونية ، حيث تعد هذه الأخيرة أداة لإسباغ المشروعية القانونية على المتطلبات السابقة و بالتالي إسباغ هذه المشروعية على عمليات التحول الرقمي بشكل عام من جهة ، و من جهة أخرى بسط و تقرير الحماية القانونية لمختلف عناصر عمليات التحول الرقمي و كذا مخرجاته . و في هذا الإطار تتمحور إشكالية هذه الورقة البحثية حول : طبيعية المتطلبات القانونية الواجب توفرها في إطار مرافقة عمليات التحول الرقمي بما يضمن تكريس و حماية لمختلف المعاملات التي تتم في إطار البيئة الرقمية ؟ ABSTRACT Engagement and integration into the digital transformation process necessitates and requires the availability of a number of different requirements of a political, structural, institutional, technical and human nature, in addition to legal requirements, as the latter is a tool for conferring legal legitimacy on the previous requirements and thus conferring this legitimacy on the transformation processes. Digital transformation in general, on the one hand, and on the other hand, extending and determining legal protection for the various elements of digital transformation processes as well as its outcomes. In this context, the problem of this research paper revolves around: the nature of the legal requirements that must be available within the framework of accompanying digital transformation processes in a way that ensures the dedication and protection of the various transactions that take place within the framework of the digital environment?
