The Shift Towards Civil And Administrative Penalties Instead Of Criminal Liability In Competition Law.

Abstract

Abstract: The concept of decriminalizing anti-competitive practices stems from a contemporary perspective on the role of the law in regulating economic and commercial activities, which emphasizes a transition from criminal sanctions to the application of financial and administrative sanctions, and the focus is on economic deterrence rather than criminal punishment. There has been a notable development in competition law, where repressive policies have been relaxed and imprisonment has been replaced by more severe fines, reflecting the legislator's recognition of the importance of creating a healthy competitive environment that encourages innovation and efficiency. After the decriminalization, the role of Competition Councils has transformed, granting them authority to enforce measures against practices that breach competition law. These practices are now considered financial offenses rather than economic crimes, requiring the imposition of specific penalties.
