الرّقابة البرلمانية على العمل الحكومي في دُول المغرب العربي

الملخص
الملخص: إنّ البرلمان باعتباره السلطة التشريعية والتمثيلية للإدارة العامة للشعب والامة، وباعتباره الركن الأساسي والفعال في تجسيد وضمان مؤسساتي ووظيفي فمكنه المؤسس الدستوري من وسائل وآليات تمكنه ممارسة عمله الرقابي على العمل الحكومي في عدة دول وسوف نركز بحثنا على دول المغرب العربي، وبالتحديد الجزائر، المغرب وتونس، كما أنّ الدراسة ستكون طبقاً للدساتير الأخيرة وللأنظمة الداخلية الاخيرة لهذه البرلمانات والمعمول بها حاليا. تحتل عملية الرقابة البرلمانية على أعمال الدولة بصورة عامة وعلى أعمال الحكومة بصورة خاصة مكانة حيوية وهامة في عملية تنظيم سلطة الدولة ومؤسساتها الدستورية، والرقابة البرلمانية على أعمال السلطة التنفيذية من بين أهم الاليات العملية الدستورية لضمان دولة القانون، وتعتبر هذه الرقابة رقابة سياسية يمارسها البرلمان على أساس دستوري، كما تتميز بكونها محصورة بأعضاء السلطة التشريعية. Abstract: The parliament, as the legislative and representative authority of the public administration of the people and the nation, and as the essential and effective pillar in embodying and guaranteeing institutional and functional aspects, has been equipped by the constitutional founder with means and mechanisms that enable it to exercise its oversight over government activities in several countries. We will focus our research on the Maghreb countries, specifically Algeria, Morocco, and Tunisia. The study will be based on the latest constitutions and the recent internal regulations of these parliaments currently in force. The process of parliamentary oversight over state actions in general and government actions in particular occupies a vital and important position in organizing state authority and its constitutional institutions. Parliamentary oversight of the executive branch is one of the most significant constitutional mechanisms to ensure the rule of law. This oversight is considered a political control exercised by parliament on a constitutional basis and is characterized by being limited to members of the legislative authority.
