الحماية الذكية للحقوق المالية للمؤلف في البيئة الرقمية باستخدام تقنية البلوك تشين Smart Legal Framework For Authors’ Financial Rights In The Age Of Blockchain

الملخص
في عصر الرقمنة المتسارعة، أصبحت حماية حقوق المؤلفين من التحديات البارزة التي تواجهها القوانين التقليدية، إذ ساهمت شبكة الإنترنت في تسهيل نسخ وتوزيع المحتوى الإبداعي دون الرجوع إلى أصحاب الحقوق، مما أدى إلى انتهاكات متكررة لحقوق الملكية الفكرية، خاصة الحقوق المالية للمؤلفين، ولتدراك هذا الإختلال تم التوجه نحو الإعتماد على تقنية البلوك تشين كمنصة رقمية عادلة في ضبط طرق أداء المقابل المالي للمؤلفين، وتحقيق الشفافية، وضمان أفضل توزيع للحقوق المالية للمؤلفين وأصحاب الحقوق المجاورة، وما يمكن أن يكون عليه مستقبل الإدارة الجماعية لحقوق المؤلف في ظل هذه التقنية، كونها آلية مبتكرة لضمان حماية الحقوق وتوثيقها بشكل لا مركزي وآمن وشفاف. Abstract : In the era of rapid digitalization, the protection of authors' rights has become one of the prominent challenges faced by traditional legal systems. The Internet has facilitated the copying and distribution of creative content without recourse to the rights holders, leading to repeated infringements of intellectual property rights, particularly the financial rights of authors. In response to this imbalance, there has been a shift toward adopting blockchain technology as a fair digital platform for regulating the mechanisms of financial remuneration for authors, ensuring transparency, and achieving optimal distribution of financial rights for authors and related rights holders. This also raises the question of the future of collective rights management under this technology, as it represents an innovative mechanism for the decentralized, secure, and transparent protection and documentation of rights.
